Terms & Conditions

These terms and conditions govern the yacht charter services provided by Explera DMC ("Company", "we", "us") to clients ("Charterer", "you") in Thailand waters. By booking a charter, you agree to these terms.

All charters are subject to Thai maritime law and regulations. The Company holds all necessary licenses and insurance for commercial yacht operations in Thai waters.

Charter agreements are confirmed only upon receipt of deposit payment and signed charter agreement. Verbal agreements are not binding.

2.1 Reservation Process

• All bookings require a signed charter agreement and deposit payment
• 30% deposit required to confirm booking
• Remaining balance due 48 hours before charter departure
• Bookings are provisional until deposit is received

2.2 Payment Methods

• Bank transfer (preferred method)
• Credit card (Visa, Mastercard) - 3% processing fee applies
• Cash payment (Thai Baht or USD)
• All prices quoted in USD unless otherwise specified

2.3 Price Inclusions

• Yacht charter for specified duration
• Professional crew (captain and crew members)
• Fuel for standard itinerary
• Basic safety equipment and insurance
• Fresh towels and basic amenities
• Snorkeling equipment (where applicable)

3.1 Charterer Cancellation

• 7+ days before charter: Full refund minus 10% processing fee
• 3-6 days before charter: 50% refund of total charter fee
• Less than 3 days: No refund
• No-show: No refund

3.2 Weather Cancellation

• Captain has final authority on weather-related safety decisions
• Weather cancellations by Company: Full refund or free rescheduling
• Partial weather delays: Pro-rated refund for unused time
• Weather monitoring begins 48 hours before departure

3.3 Company Cancellation

• Mechanical issues: Full refund or alternative vessel
• Force majeure events: Full refund, no additional compensation
• Government restrictions: Full refund or rescheduling

4.1 Safety Requirements

• All guests must follow crew safety instructions
• Life jackets must be worn when instructed by crew
• Swimming and water activities at guest's own risk
• No diving from yacht without crew permission
• Children under 12 must be supervised at all times

4.2 Liability Limitations

• Company liability limited to charter fee amount
• Guests participate in activities at own risk
• Company not liable for personal injury due to guest negligence
• Travel insurance strongly recommended
• Medical conditions must be disclosed before charter

4.3 Insurance Coverage

• All vessels covered by marine liability insurance
• Third-party liability coverage included
• Personal belongings not covered - secure valuables
• Medical evacuation insurance recommended

5.1 Prohibited Items & Activities

• Illegal drugs or substances
• Excessive alcohol consumption (crew discretion)
• Glass containers on deck areas
• Smoking in enclosed areas
• Fishing without proper licenses
• Damage to marine environment

5.2 Guest Responsibilities

• Respect crew instructions and yacht property
• Report any damage immediately
• Follow environmental protection guidelines
• Maintain appropriate behavior toward crew and other guests

5.3 Damage & Additional Charges

• Guests liable for damage beyond normal wear
• Cleaning fees for excessive mess: $100-500
• Equipment replacement at full retail cost
• Fuel surcharges for route changes: Market rate

6.1 Charter Modifications

• Route changes subject to weather and safety conditions
• Time extensions available subject to vessel availability
• Guest count changes must be approved 48 hours prior
• Additional services can be arranged with advance notice

6.2 Dispute Resolution

• All disputes governed by Thai law
• Mediation preferred before legal action
• Bangkok courts have exclusive jurisdiction
• English language contracts take precedence
